Consumers are able to protect themselves by informed choices and responsible behaviours in practice.

General principles

The purpose of the Cosmetics Directive is to approximate the laws of the Member States relating to cosmetic products so as to ensure their free movement in the EU market. The provisions of the Cosmetics Directive have been implemented in Malta by the Cosmetic Products Regulations (L.N. 424 of 2004) under the Product Safety Act, 2001. Read more

What are Cosmetics?

A cosmetic product is any substance or preparation intended to be placed in contact with the various external parts of the human body or with the teeth and the mucous membranes of the oral cavity, with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance, and/or correcting body odours, and/or protecting them or keeping them in good condition. Such products must not be liable to cause damage to human health when they are applied under normal conditions of use. Read more

Market surveillance

Every EU Member State must appoint authorities which are responsible for Market Surveillance. Market Sureveillance is a process by which every member state ensures that products that are placed on the market are safe and in conformity to applicable legislation. The Cosmetics Directive stipulates that the manufacturer, his agent, or the person to whose order a cosmetic product is manufactured, or the person responsible for placing an imported cosmetic product on the Community market must keep product information and safety information available to the competent authority. Notification to the competent authority

After a Cosmetic Product is imported within the EU, for the first time, the manufacturer/importer must notify the competent authority of the Member State. Read more

Composition

A cosmetic product is any substance intended to make contact with external parts of the human body, or inside the mouth, with the intention of cleaning or perfuming them, changing their appearance, correcting odors, protecting them or maintaining their good condition.
